Debt Collector Law
There are laws in place to protect the consumer from bad debt collectors.
The federal FDCPA and California’s Rosenthal Act are two of them. They protect people from abusive debt collectors and from collection lawsuits brought by companies that claim to have bought your old credit card account.
Don’t just take their word for it. Make them prove they actually own the account.
Many times they are unable to do that. If you are required to file a lawsuit against the debt collector for violating these laws, you could recover damages, attorney’s fees and court costs. You can also notify the Federal Trade Commission for violations of these laws. You can go to their website to file a complaint.
