DIVORCE AND FAMILY LAW MATTERS

California is a no fault divorce state. This means that “grounds” are not required in order to obtain a divorce from your spouse. Additionally, your spouse does not have to agree to the divorce in order for the court to grant it.

The grounds for a divorce in California are irreconcilable differences. This means that differences have come up between you and your spouse and you no longer with to continue in the marriage. THAT’S IT. This is all it takes in California.

The divorce process takes at a minimum, six months before a final judgement can be entered. It can take longer to process through the system if there are uncooperative spouses or difficult issues.

Most issues involved in the dissolution of your marriage are:

  1. CHILD ISSUES: Custody and visitation
  2. MONEY ISSUES: Child Support and Spousal Support (Alimony)
  3. PROPERTY ISSUES: What property is subject to division and how will it be divided.
  4. COSTS OF THE DIVORCE – Attorneys Fees and Costs
  5. HOW TO SELECT AN ATTORNEY

Family Law also encompasses modification of prior orders when necessary. This may include the following:

  1. MODIFICATION of the child sharing plan
  2. “MOVE AWAY” orders
  3. INCREASING OR DECREASING CHILD AND/OR SPOUSAL SUPPORT
  4. ENFORCING THE COURT’S PRIOR ORDERS
  5. ESTABLISHING AMOUNTS OWED UNDER COURT ORDERED CHILD AND SPOUSAL SUPPORT ORDERS THAT WERE NOT COMPLIED WITH
